§ 15-28. Jurisdiction and procedure.

  • The justice of the peace in the ward in which a violation of subsection 15-27(i) occurs, shall have concurrent jurisdiction with the district court for prosecution of any such violation. It is the intent of the parish council-president government that justices of the peace within Tangipahoa Parish shall have all of the powers and authority allowed under law. In addition, a constable within the parish shall serve summons and subpoenas , issued by a justice of the peace, for such violations occurring anywhere in the ward in which the constable serves.

    The fines and/or collected by any justice of the peace, pursuant to this article and/or state law, shall be paid directly to the parish, after which the justice of the peace court shall present the parish with a bill for its services based on the time expended in the prosecution of these violations and the expenses incurred. However, in no event shall the bill for services and expenses be in excess of 50 percent of the total fine collected by the justice of the peace court.
