§ 15-129. Civil penalties.

A violation of section 15-127 as set forth hereinabove shall be a nuisance, such that any party may bring an action in a court of proper jurisdiction to seek an injunction and mandamus to require the property owner or owners to repair and/or upgrade the individual sewerage system and to enjoin the owner or owners or anyone else from occupying the property and discharge any sewerage or utilize the individual sewerage system until it has been upgraded and/or repaired to meet all current state regulations as provided in Chapter XIII of the Louisiana Sanitary Code. The prevailing party, specifically including but not limited to an adjacent landowner, who brings this action shall also be entitled to receive a judgment for any damages he/she/they/it suffered and all costs for the bringing of this action, including reasonable attorney fees.
