§ 16-16. Prohibition on the unauthorized use of garbage containers.

(a)

It shall be unlawful for any person to place garbage, refuge, trash, waste and/or other materials into a garbage container of any size not owned by, leased to or otherwise permitted for use by the person who is placing the garbage, refuge, trash waste and/or other materials therein. The foregoing notwithstanding, this prohibition shall not apply to a person who is placing the garbage, refuge, trash, waste and/or other material into a garbage container at the request, direction and/or with the express permission of the person who owns, leases or is granted use of this garbage container.

(b)

Whoever violate the provisions of this section shall be guilty of a misdemeanor criminal offense and shall be punished by a fine of $500.00 and/or shall be imprisoned for a term of 30 days. Each separate occurrence shall constitute separate offense.
