Chapter 16. OFFENSES AND MISCELLANEOUS PROVISIONS |
Article I. IN GENERAL |
§ 16-9. Defacing, tampering with traffic control devices.
(a)
It shall be unlawful to deface, destroy, remove, interfere with, tamper with or intentionally damage any traffic control sign, signal, device or markings, road name signs, buildings or equipment (trucks, tractors, heavy equipment, etc.) belonging to and/or erected by the parish council.
(b)
It shall be unlawful for any private person or concern to have in his possession any traffic control sign, signal, device or highway marking sign belonging to the parish council, unless he has an original bill of sale evidencing a chain of title from the parish council, which bill of sale must clearly identify the item or items by description and total number.
(c)
This section shall not apply to the employees of the department or of any contractor or subcontractor or other person whose proper and lawful duties require them to go upon any portion of a highway which is under construction or in the process of being repaired, nor shall the presence of such persons, or that of machinery being operated by them, upon any portion of a highway, which is under construction or in the process of being repaired, be deemed negligent.
(d)
Anyone displacing, removing or in any way interfering with such road signs, danger signals and/or signal lights, in violation of this section, shall be punished as provided by section 1-13 of this Code. Fifty percent of the fine shall be returned to the parish council's missing sign program.
