§ 19-146. Created; boundaries; protests.
(a)
A gravity drainage district composed of all the territory situated within the limits of ward one of the parish as such ward was constituted on July 9, 1974, is hereby created in accordance with the authority of R.S. Title 38, Chapter 7, and constitutional and statutory authority supplemental thereto, such district being designated and named gravity drainage district no. 5 of the parish. The gravity drainage district as herein created contains within its limits more than five landowners. In the creation of the gravity drainage district, the right is reserved by the council, in accordance with the provisions of R.S. 38:1753 to create a gravity subdrainage district, if the need arises in the future. Gravity drainage district no. 5 of the parish created herein shall be and is a subdivision of the state, within the meaning of the constitution and statutes of the state relating to incurring debt and issuing bonds therefor.
(b)
Within 30 days from the date of the first publication of the ordinance creating this gravity drainage district no. 5 any owner of property within the limits of the district, or any interested citizen may appeal to the courts for the purpose of contesting the action of the council, or urging any objection to the inclusion of his lands within the district. After this time, the action of the council shall be absolutely incontestable for any cause whatsoever and it shall be conclusively presumed that gravity drainage district no. 5 of the parish is regularly and legally created and that each and every acre of land in the gravity drainage district is the character of land that should be included therein. No court shall be vested with jurisdiction to entertain any cause which calls into question any validity or regularity of the action of the council in creating gravity drainage district no. 5 of the parish or raises the question of whether the lands located therein should have been included, drained naturally or by gravity, or will be benefited by gravity drainage district works. Nothing contained in this subsection shall be construed as requiring the governing authority of gravity drainage district no. 5 to await the expiration of the 30-day limitation herein provided before proceeding to organize and to do and perform all of the acts or things authorized to be done and performed by them under the authority of R.S. 38:1751 et seq.
