§ 23-26.5. Adoption of state sanitary code.
(a)
The parish council-president government does hereby adopt for implementation and enforcement Chapter 13 of the Louisiana Sanitary Code, as it may be amended, particularly but not limited to the provisions not requiring connections to community type sewer systems, as provided therein, with the following exceptions and more stringent requirements to-wit:
Individual sewer systems are allowable: The use of an individual sewer system is allowable when all the requirements of Chapter 13 of the Louisiana Sanitary Code are met and the following requirements and additional conditions are also met:
(1)
On lots where an area of one acre of land is involved, provided that no more than two residence structures, homes, or mobile homes shall be located on one acre of property.
(2)
On small lots, being a lot, plot or site which has a minimum total area of 21,780 square feet and a minimum frontage of 60 feet, provided that no more than one residence structure, home, or mobile home be located on said site except as to pre-existing recorded lots.
(3)
For individual lot sites, regardless of size, when the installation of an individual sewer system is proposed in order to renovate or replace a pre-existing inadequate or malfunctioning individual sewage system. In such case, there must be an approved individual sewer system utilized. This provision shall apply to the renovation or replacement of pre-existing systems only and shall not be utilized to circumvent other requirements, particularly those relative to minimum lot sizes for new residence and subdivision development.
(4)
No individual sewer system shall be permitted, except as pre-existing individual sewer systems, as set forth hereinabove, on any lot, plot or site, except as to pre-existing recorded lots having an area of less than 21,780 square feet and 60 feet of frontage, nor may the state or local officer consider any lesser proposal.
(5)
In the case of parish approved subdivisions filed with the planning commission, no individual sewage systems shall be permitted, except as to pre-existing individual sewage systems as set forth hereinabove, on any lot, plot or site having an area of less than 22,500 square feet and 125 feet of road frontage nor may the state or local health officer consider any lesser proposal. However, the 125 feet of frontage may be waived for up to 15 percent of the total number of lots in the development if the frontage is not less than 60 feet with an average width of at least 125 feet per lot throughout the entire subdivision.
(b)
The Tangipahoa Parish Sewerage District Number One and all other persons and governmental entities shall comply with all local, state and federal guidelines, rules, regulations and other applicable laws pertaining to the treatment and collection of sewerage, specifically including the Louisiana Sanitary Code, as amended from time to time, and the Tangipahoa Parish Code of Ordinances as amended from time to time.
(c)
The above and foregoing notwithstanding, the parish building and planning commission is hereby granted the authority to waive the minimum road frontage as set forth hereinabove by accepting subdivision plans with not less than 60 feet of road frontage provided that the lot site in the subdivision meets all of the other requirements set forth hereinabove and the minimum requirements of the Louisiana Sanitary Code.

Editor's note
It should be noted that this section is not retroactive and does not apply to any lots recorded by the parish clerk of court's office before the date of enactment (September 26, 1994) of this ordinance. Any existing lots of record with the parish clerk of court shall be solely governed by the Louisiana Sanitary Code.
