§ 23-33. Private business of emptying, cleaning, etc., sewage facilities; records.

  • (a)

    Persons engaged in emptying or cleaning sewage facilities or transporting such in parish must be a state licensed sewage hauler and must have a disposal area approved by the state health officer or his authorized representative.

    (b)

    Any persons transporting sewage inside the boundaries of parish must complete a load manifest as provided by the parish. Such persons shall keep a daily record of all emptying, cleaning, and dumping activities conducted by them. Such record shall include the times and locations of such activities.

    (c)

    Sewage generators are liable for the proper disposition of their waste. Any persons wanting to have their septic tanks or other like facilities emptied, cleaned, pumped, or transported must call the parish and request a load permit number. A state licensed hauler [haulers] must be used to transport sewage.

    (d)

    Any sewage load generated within parish must have a load permit number prior to emptying, cleaning, or transporting the waste.

    (e)

    Any persons transporting sewage within the parish shall be subject to periodic inspections of load contents and paperwork.

    (f)

    Any business located within parish that engages in the emptying, cleaning, and/or transporting of sewage shall provide to the parish a copy of any and all permits required by the State of Louisiana.

    (g)

    Any business located within parish that engages in the emptying, cleaning, and/or transporting of sewage shall be randomly inspected by an authorized parish representative. Inspections shall include, but not be limited to, review of all load manifests depicting sewage generators and disposal facilities. Inspections may include review of other documentation as required by the business' operating and transporting permits. Authorized parish representative shall be determined by the parish president or his designated representative.

    (h)

    Any persons wishing to establish a business to engage in the emptying, cleaning, and/or transporting of sewage within the parish after November 1, 2006, must notify the parish in writing as to the first day of operation.

    (i)

    Any business in operation prior to November 1, 2006 shall comply with subsections (f) and (g).

    (j)

    Any person transporting sewage within the boundaries of the parish must have name, address, phone number, and state permit number in plain view on both sides of vehicle in three-inch letters.

    (k)

    Whoever violates any provision of this chapter shall be punished as provided by section 1-13 of this Code.
