§ 26-2. Burning ban.
(a)
In the event of a severe drought as declared for all or any portion of Tangipahoa Parish, Louisiana, by the United States Weather Service, the Tangipahoa Parish President shall have the authority to declare a ban on all outdoor burning and the use of fireworks by the public. In this event, it shall be unlawful for any person to start or set an outdoor fire and/or to ignite any fireworks. There is excepted from this ban any fire set by fire department personnel acting within the course and scope of their duties to suppress fires and in the case of a controlled fire located solely within the property boundaries of a commercial and/or industrial plant, works or shop which is entirely fenced and has personnel on site to monitor and control the fire at all times, day and night, until it is extinguished.
(b)
On notification of the Tangipahoa Parish Council and published at least once in the official journal of the Tangipahoa Parish Council-President Government so as to serve notice to the public the parish president may declare a "burn ban" for the purpose of property and public safety for a period as long as deemed necessary.
(c)
Whoever violates the provisions of this section shall be guilty of a misdemeanor crime and shall be subject to the penalties provided in section 1-13 of the Code of Ordinances of Tangipahoa Parish, Louisiana.
