The above and foregoing notwithstanding, the owner or owners of hunting dogs, who
are supervising their dogs during hunts or training, shall not be criminally responsible
should the dogs inadvertently trespass onto the lands of another provided that the
dogs are wearing a collar clearly identifying the owner of the dogs and that they
are hunting and training the hunting dogs on property that they do have permission
to hunt or train dogs upon and do not intentionally allow the dogs to trespass onto
the lands of another. However, the owners of hunting dogs that trespass onto the lands
of another shall be responsible for any and all civil damages caused by the hunting
dogs to the property onto which the hunting dogs are trespassing, specifically including
but not limited to damages to animals, growing crops, gardens and/or flower beds as
set forth hereinabove.
