§ 19-712. Powers.

  • The sewerage district shall be known and is hereby designated as sewerage district no. 1 of the parish (hereinafter referred to as the sewerage district), and as thus originally created shall constitute a public corporation and political subdivision of the state as allowed by law, and shall have all of the powers and privileges granted by the constitution and statutes of this state to such subdivisions including perpetual existence; the power to incur debt and contract obligations; sue and be sued; to have a corporate seal; to do and perform all acts in its corporate capacity and in its corporate name, which is necessary and proper for the purpose of constructing and maintaining sewers and sewerage disposal works within its territorial limits and generally to perform any and all acts necessary to carry out the objects and purposes of its creation; to expropriate property for the purpose of acquiring rights-of-way for the laying and installing of sewers and sewerage disposal works, and to acquire machinery, tools and equipment, essential to the proper accomplishment of the purposes of its creation; to establish, maintain and collect rates, charges or connection charges for any service rendered by the sewerage district to be paid by the owner of each parcel of real estate or building that is connected with and uses or is served by the sewerage system of the district, and to readjust such rates, charges or connection charges, from time to time and as may be required. And, further, for the establishment of necessary sinking fund for the payment of the principal and interest of any revenue producing utility bond which may be issued and sold for the purpose of constructing, acquiring, extending or improving the sewerage system. And to grant authority to incur debt, to issue bonds and to levy the necessary taxes; and, to adopt and enforce rules and regulations or ordinances, exact penalties and to institute such actions at law as may be within its corporate power for the prompt collection of the respective rates or connection charges fixed for services rendered by the sewerage system and as may be allowed by law. And, to further allow and grant all powers necessary and as permitted by law to such public corporation.
